Temporary Staffing Agency Required to Indemnify Hospital for Wrongful Death

A plaintiff’s failure to timely name a hospital temporary staffing agency in a wrongful death action against the hospital, alleging the staffing agency’s nurse caused the decedent’s death, did not bar the hospital from seeking indemnity from the staffing agency under an indemnity agreement.

The plaintiff’s claim against the hospital was timely and the agreement did not condition the hospital’s right to indemnity on the plaintiff having a direct claim against the agency. See: Medical Staffing Network, Inc. v. Connors, 2012 WL 181569 (Ga.App. Jan 24, 2012) (not designated for publication).
